Effective with billets manufactured after January 1, 1999, The Dow Chemical Company warrants

that for a period of ten years, STYROFOAM* extruded polystyrene Buoyancy Billets, when installed

in accordance with application recommendations, will not sink or become waterlogged. The flotation

performance of the product will not be affected materially by cracking, peeling or fragmentation.

When installed in accordance with applicable recommendations, the flotation performance of the

product will not be affected adversely through puncture, penetration or damage by animals. The

product contains a fire retardant. If a STYROFOAM Buoyancy Billet is determined by Dow not to

meet the warranty conditions, then Dow, at its option, will either deliver to the owner a quantity

of buoyancy billets to replace the non-performing billets or, at The Dow Chemical Company’s sole

discretion, refund to the owner the original purchase price of the billets. Dow’s total liability under

the limited warranty is expressly limited, at Dow’s option, to replacement of the product or refund

of the purchase price of the product.

Conditions. This warranty shall apply only when STYROFOAM Buoyancy Billets are installed in

accordance with all applicable specifications, recommendations and guidelines in effect at the time

of installation. This warranty shall be void if, in Dow’s sole judgment, the performance of the product

has been impaired by unapproved alteration to the product or damage to the product resulting

from unapproved alteration.

Exclusion of other warranties. THIS WARRANTY IS IN LIEU OF ALL OTHER GUARANTEES AND

WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY

AND FITNESS, AND SHALL NOT BE EXTENDED OR ALTERED EXCEPT BY WRITTEN INSTRUMENT

SIGNED BY DOW AND THE OWNER. THERE ARE NO WARRANTIES OR GUARANTEES WHICH

EXTEND BEYOND THE DESCRIPTION SET FORTH IN THIS WARRANTY.

Exclusions From Limited Warranty. Dow does not warrant the compatibility of any other

product with STYROFOAM Buoyancy Billets, and does not assume any liability for any incidental

or consequential damages, including, but not limited to, harm to persons or property. This

warranty applies only to STYROFOAM Buoyancy Billets used in waterways subject to the Army

Corps of Engineers Shoreline Use Permit Conditions cited in Code of Federal Regulations 36 CFR

Part 327.30 Appendix C. Product must not be used within 40 feet of a line carrying fuel. The product

is subject to ultraviolet degradation when exposed to direct sunlight over time, and should be

protected from prolonged exposure to direct sunlight during storage and use. STYROFOAM

Buoyancy Billets are combustible and should be protected from high heat sources.
